Tinjauan Yuridis terhadap Konsep Negosiasi sebagai Alternatif Penyelesaian Sengketa dalam Sengketa Bisnis di Indonesia yang Berlandaskan Nilai Pancasila

This thesis discusses the Concept of Negotiation As Alternative Dispute Resolution In Business Dispute In Indonesia Based on Pancasila Perspective. The results of research which is using normative legal research methods concluded that: 1 Negotiation is chosen by the parties as major alternative dispute resolution rather than other methods of dispute resolution because of the ease of negotiation process implementation. Although sometimes negotiation is not the final step in resolving disputes. 2 Negotiation and Musyawarah procedures generally are same. But the Musyawarah philosophical values, which is based on Pancasila rejecting individualism philosophical values ​​contained within the negotiations. Furthermore, it is recommended that the Law Maker to make written rules to balance the position of the parties in the negotiations
