Perlindungan Konsumen oleh Pelaku USAha Property dalam Pembangunan Perumahan Ditinjau dari Undang-undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen (Studi di Kota Pontianak)

This thesis focuses on consumer protection by business operators in the construction ofresidential properties in terms of Law No. 8 of 1999 on Consumer Protection (Studies InPontianak City). From other research by the author using sociological research methods, it isconcluded: 1). That in general the losses experienced by residential consumers in Pontianakinclude: type of good wood to frame or door or use a pole that is not clear what kind; crackedbuildings occupied either before or after some while occupied; paint dull quickly; and zinczincrapid leaked prematurely and so on. On this side, most consumers improve their ownhousing without any complaint or claim to the businesses or housing developers, but there arealso consumers who ask or complain or claim to businesses or developers of housing andsimultaneously hold the top of the building is done. Generally, consumer complaintssubmitted directly to businesses without involving a third party that the institutionsestablished by the government or non-governmental concern to protect consumers. Theseapproaches are conducted in order to demand accountability from the voluntary housingdeveloper businesses. So only a moral obligation only of businesses and housing developersnot as legal obligations as set in the consumer protection laws. Thus the protection providedby the business to consumer housing developer is relatively low. Brochures, advertising,promotion, or whatever his name is often times do not correspond to reality. 2). Efforts thatcan be performed by a residential consumer can be harmed through the courts and outside theidvidu pengadilan.baik, groups, or NGOs. To demand or claim made by an individualresidential consumers who suffer loss then the legal basis for the civil responsibility of thedeveloper housing demand is Act No. 2 of 1986 in conjunction with Law No. 8 of 2004 onthe General Court, Revised Indonesia Regulation updated (RIB) or Het Herziene InlandscheReglement (HIR) Stb. 1941- 44, and Article 45 of Law No. 8 of 2009 on ConsumerProtection. For the group of consumers or non-governmental organizations maasyarakat, thenthe law is used that Supreme Court Rule (PERMA) No. 1 of 2002 on Class Action event(class action). Special out of court through Law Number 30 Year 1999 on AlternativeDispute resolution and Article 45 paragraph (2) in conjunction with Article 47 of Law No. 8of 2009 on Consumer Protection and can also be done via the Consumer Dispute SettlementBoard as set out in the Articles 49 to 58 of Law No. 8 of 1999 on Consumer Protection. Thesuggestions are: 1). Government as body builder and consumer protection watchdog is activeagain to provide guidance and oversight so that no part of consumers of housing and2residential businesses really have a balanced position. 2).
