Penerapan Prinsip Kehati-hatian dalam Pelaksanaan Pemberian Pinjaman di Koperasi Credit Union

This thesis discusses the Application of Prudential Principles in the Implementation of Loans at Credit Union Cooperatives. This research uses normative and sociological law research methods. From the results of this thesis research it is concluded that the Prudential Principle Arrangement Can Provide Protection for Cooperatives In connection with the Savings and Loans Agreement. The prudential principles of the regulation can provide protection for the cooperative in connection with the loan saving agreement which is implemented by credit is one form of loan money, in a loan loan agreement is often required to have a debt guarantee that can consist of various forms and types. Debt assurance in positive law in Indonesia there are various laws which regulate or related to debt guarantee which is often referred to as guarantee law. The provisions of the applicable law provide arrangements that will protect the parties concerned with the loan money and the debt guarantees. Cooperative as a business entity that provides credit to the debtor must make safeguards so that the credit can be settled by the debtor concerned. Unsecured loans by the debtor either wholly or partially will be a loss to the Cooperative. Losses indicate a relatively large amount will affect the level of health of cooperatives and the continuity of cooperative efforts. Therefore, no matter how small the value of money from credit that has been given to the debtor must remain secure in accordance with the principle of prudence. In general, credit security can be done through the credit analysis phase and application of applicable legal provisions. The relationship between credit guarantee and credit security can be inferred from the provisions of Article 1131 of the Civil Code so that it is another effort or alternative that can be used by the Cooperative to obtain loan repayment upon the debtor's default.
