Perubahan Peruntukan Dan Fungsi Zona Inti Kawasan Konservasi Dalam Pengelolaan Wilayah Pesisir Dan Pulau-pulau Kecil Untuk Kegiatan Eksploitasi Di Indonesia

Management of the coastal areas and small islandson the the constitution of the Republic of Indonesia of 1945 Article 33 paragraph (3) and (4),, must pay attention to the economic analysis, environmental analysis, and social analysis, so that the construction can be done sustainably. The importance of balance between the demand for development triggered to the needs of the preservation of that does not preclude the next generation to benefit from the natural resources is, this thesis was focused discussion on core zone conservation area that is part of conservation area protected devoted as the area protection habitats and population resources was found in the coastal and small islands and its use limited to research. The problems which discussed are the designation and functions of the absolute core zone for the protection of the habitat and population of the coastal regions and small islands, be inconsistent with the existence of the article which provides substantive gaps of the possibility to change the designation and functions of the core zone of the conservation area for the activities of exploitation, in other words blurs the norm which set the core zone as a protected area. Furthermore, the type of research which used in this journal is research law normative with the statute approach and conceptual approach with the result as follows: the first, was that characteristic of the ocean are can not be separated that allows change typical and quality of core zone conservation area, the rules of change in designation and functions core zone conservation area required by using Minister for Public Works Regulation No. 18/ PRT/ M/ 2010 on guidelines revitalization area as a basis. Second, the word of “exploitation” containing ambiguous, allowing chink political transactional that its use less pay attention to conservation, so that the utilization gives less benefit sustainable development
