Tanggung Jawab Hukum Badan Penyelenggara Pendaftaran Tanah dalam Sengketa Pertanahan di Wilayah Jakarta Barat

Basic Agrarian Law number 5 of 1960 in article 19 mentioned that in order to ensure legal certainty and the certainty of land rights has set out the necessity to carry out the registration of land across Indonesia, a result of the land register is a certificate issued by the Office of the Land. This certificate serves as a strong evidentiary tool for holders of land rights, meaning that it can be changed if there is a fallacy that can be proved otherwise by the Court. Land registry aimed at ensuring legal certainty but in reality is different, this is caused by a few things such as the Land Office not to pay attention to administrative data and the status of the land register in the certificate issuance process, as evidenced by the case of the issuance of the certificate upon the land is disputed by the West Jakarta Office of the Land against the lands South Meruya residents. Based on the cases of the authors are interested in reviewing quagmire that is about responsibilities of the Office of the Land in the issuance of the certificate upon the land's status dispute.The purpose of this research is to know the background of the occurrence of the issuance of the certificate upon the land's status dispute, knowing the Land Office's responsibility in publishing the certificate, as well as the land dispute resolution efforts.The methods used in this study is an empirical juridical, with data being used is the primary data and secondary data. Primary Data is sourced to the study of the field with the observation and interview techniques, whereas secondary sourced data on research or study document libraries.Based on the results of the study revealed that: 1) the background of the dispute of land South Meruya occurs due to an execution plan based on the ruling of the Supreme Court No. 570/K/Pdt/1999 dated 31 March 2000 that triggers the reaction people who want to defend their rights, the reaction in the form of a lawsuit filed by the resistance by the people to the West Jakarta District Court 2) responsibility of the Office of the Land in dispute is still confirms the certificate that is owned by residents in Meruya Selatan. 3 settlement Efforts) in case of dispute is resolved by the Court in Meruya (litigation) proceed with mediation between PT. Portanigra with South Meruya citizens.The conclusions of the study results is that the emergence of a dispute between PT. Portanigra with South Meruya citizens caused by the execution plan of land South Meruya, due to this execution plan provides protection with Land Office confirms the certificate owned by the residents, whereas this case resolution efforts with litigation
