Analysis of the legal framework and comparison of cadastral systems in Austria and Slovenia

In the diploma thesis, the legal framework, which defines the scope of the Land Cadastre in Austria, is studied and compared to the Slovenian. The countries of Austria and Slovenia share a common initial development of land cadastre, which dates back in the era of Austrian Empire and later on of Austro-Hungarian state. After the WWI, with disintegration of the Austro-Hungarian state, the separated\ud development of land cadastral systems began in Austria and Slovenia. Despite separated development of the land cadastral systems, the Austrian and Slovenian systems are still mutually comparable due to common origins, when the fundamentals of the systems were defined. For the purpose of presentation of the land cadastre system in Austria and its current state, the following legal framework was used:\ud Federal Law on the measurement of land (Vermessungsgesetz– VermG), Regulation of land measurement (Vermessungsverordnung– VermV) and Federal Civil Technical Act (Ziviltechnikergesetz– ZTG). In order to present the system in Slovenia the Real Estate Recording Act (ZEN) and the Rules Regulating the limits and alteration of the information and registration in the land register were discussed in detail. The comparison of cadastral systems between both countries has been additionally illustrated on study case of land subdivision procedures (amalgamation and division) of land plots in Austria and Slovenia according to the current legislation
