TINJAUAN. PERJANJIAN LISENSI DALAM MENGEMBANGKAN INDUSTRI

The predominant vehicle for controlling technology transfers across national borders is the "license- or "franchise" contract. The holder of a patent, copyright or trademark in one country first acquires the legally protected right to the same in another country. The holder then licenses that right, usually for a fee known as royalty, to a person in the other country. Thus, the licensor typically conveys to the licensee rights to make, use or sell the technology. The very sharing of intelectual property rights across borders raises a risk that proprietary control of the technology maybe lost or, at a. minimum, that a competitor will be created. For these reasons, international licensing agreements are complexe legal documents that need to be carefully negotiated and drafted. Absent licensed transfers, piracy of intelectual property is increasingly commonplace. Indeed, in some developing countries such theft has risen to the height of development strategy. Saat-saat ini ketiadaan lisensi untuk transfer teknologi, pembajakan atas hak milik intelektual, tumbuh sangat cepat diberbagai tempat.
