IMPLEMENTASI PENETAPAN UPAH MINIMUM TERHADAP PEMENUHAN KEBUTUHAN EKONOMI BURUH BERDASARKAN KEBUTUHAN HIDUP MINIMUM (KHM) PADA PERUSAHAAN PADAT KARMA DI KOTA SEMARANG

Since Independent day, Indonesian labor never get a better change, it still can't increase the labor prosperity. Wages is one of the problems that always appear an unfinished that makes labor more far from prosperity. Indonesia has Minimum Wages System, where labors were paid based from wages rules that have been set by the government. This resource used qualitative method on natural object and stressing in the emit perspective that emphasized respondent's point of view without any intervention from the researcher. This research used the normative law and empiric law. Generally, minimum wages is not enough because it still lower than the Minimum Live Needs Standard (MLNS). Even in 2002 the minimum wages in Central Java is just 91% from the MLNS. One of the factors that make the labor get minimum paid is because there is no equal between the number of applicant and the job vacancy. Usually, the number of applicant is much more than what they need, and it effect on the bargaining power of the labor wages. The process of making the minimum wages started by the discussion of suggestion in the Commission of Wages Research and Social Warrant of Central Java that comes from the labor it self, industrial organizations, government and University. The materials of this discussion is formed as a decree of the minimum wages or minimum standard living in the area that been suggested by the Regent / Mayor of Central Java. The result of this discussion, though still below the MLNS, that comes as a suggestion being propose to the governor of Central Java so that can be acknowledged as the governor decision and being settled as the government conclusion. Implementation decree of the minimum wages is the responsibility of the government, industrial organization, and the labor union. The key word: labor wages becomes the interest of all. Kondisi perburuhan di Indonesia sejak kemerdekaan sampai saat ini tidak mengalami perubahan berarti yaitu tidak dapat meningkatkan kondisi ekonomi buruh. Salah satu persoalan yang selalu muncul dan tidak pernah terselesaikan secara tuntas adalah masalah upah buruh. Indonesia menganut sistem upah minimum, yaitu upah yang dibayarkan kepada buruh tidak boleh kurang dari upah minimum yang ditetapkan pemerintah. Penelitian ini menggunakan metode kualitatif pada kondisi obyek yang alami dengan mengutamakan perspektif emic yang mementingkan pandangan responden tanpa campur tangan peneliti. Penelitian menggunakan pendekatan hukum normatif dan hukum empiris. Secara umum upah buruh tergolong masih rendah karena tidak pernah mencapai standart kebutuhan hidup minimum (KHM). Bahkan pada tahun 2002 penetapan upah minimum di Jawa Tengah baru 91% dari KHM. Salah satu faktor upah buruh menjadi rendah karena tidak sebanding antara angkatan kerja dengan formasi kerja yang tersedia, kompetisi pencari kerja untuk dapat memperOleh pekerjaan sangat ketat sehinciga berdampak pada daya tawar upah buruh. Proses penetapan upah minimum didahului dengan pembahasan usulan upah minimum yang dilakukan pada Komisi Penelitian Pengupahan dan Jaminan Sosial Jawa Tengah yang terdiri dari unsur Serikat Buruh, Organisasi Pengusaha, Pemerintah dan Perguruan Tinggi. Bahan bahasan berupa usulan penetapan upah minimum atau standart kebutuhan hidup minimum di daerah yang diusulkan oleh Bupati/Walikota se Jawa Tengah. Hasil akhir pembahasan upah minimum diajukan kepada Gubernur Propinsi, Jawa Tengah untuk ditetapkan sebagai produk kebijaksanaan pemerintah dalam bentuk Keputusan Gubernur. Implementasi penetapan upah minimum merupakan tanggungjawab bersama antara pemerintah, organisasi pengusaha dan serikat buruh. Kata kunci : upah buruh menjadi kepentingan semua piha
