Dimensi Ekonomi Politik Pembentukan Hukum Di Bidang Kelautan Dan Perikanan (Kajian Masyarakat Nelayan di Kecamatan Muncar Kabupaten Banyuwangi)

As the maritime country, Indonesia has the superior product in ocean fields and the plentiful potential fish resource. According to those potentials, the fisher should be the society's group who gets the more welfare, but accidentally most of them were the more miserable society group when compared to the other society group. The poverty of fisher's group actually not predicted as the natural poverty, but caused by the structural problem. The structural poverty which fall on the most of fisher's group actually was complex, one reason is that they do not have the completed access in economic, politics, and law fields. According to the assumption that the law which regulated the politics economics of the society was created by the law institution maker which are autonomy relative, these thesis was aim for giving the answer of the problem above by taking the study setting from the society group of Muncar Banyuwangi This thesis was support from the research results with two matters of data (primary data and secondary data) The primary data which related to the law mating process was obtained directly from the fisher through the observation and interview, while the secondary data was the law regulation document and the news from mass media that collected by using the documented methods. The analysis of both the data above are using the qualitative analysis and the content analysis. The results of both the data performed as qualitative descriptive. The results showed that the law making process in ocean and fishing fields, was more top down characterized, these matters have brought the consequence as follow: 1). The law regulator that related to the fish catching for the fisher was more accommodate the interest of fish entrepreneur group on their politic economy. 2). The limited participation of the fisher society in the law making process made them have no access both in the politics economy fields that related to the fisher interest. The inaccessible fisher was not aim that they have not a weak position against the government at all. For any governmental policy which they feel injustice or appearing the loss of their politics economy interest, they often have their own way to fight their interest so that it would be accept as the part of the law constitution. The critical way they often used are making a protest, demonstration, or the other way that classified in destructive, beside by using the reporters with their mass media as the channel for influencing the law making process. Those efforts are factually effective. Although in some certain case the fisher group has an ability to force the government, but those regulations actually was not appearing the change of their social economics life. According to that problem, there is still needs the other alternative in case of deceiving the fisher society. Alternative strategy that recommended in this thesis is changing the property of catch equipment system from the individual property systerri to the collective property system. Sebagai negara maritim yang mempunyth produk tmgaulan dibidang kelautan dan perikanan Indonesia memiliki potensi sumber daya ikan yang sangat melimpah. Dengan potensi tersebut seharusnya para nelayan merupakan kelompok masyarakat yang paling sejahtera, namun kenyataannya sebagian besar dari mereka justru merupakan salah sate kelompok masyarakat yang paling miskin dibanding golongan masyarakat lainnya. Diperkirakan kemiskinan yang menimpa sebagian besar masyarakat nelayan bukan tarena kemiskinan alamiab, melainkan disebabkan karena masalah struktural. Kemiskinan struktural yang menimpa sebagian besar masyarakat nelayan sebenamya penyebabkan sangat komplek, salah satu penyebabnya adalah belum adanya akses yang mereka miliki baik dibidang ekonomi, politik, maupun dibidang hukum. Atas dasar asumsi bahwa hukum yang mengatur kegiatan ekonomi¬politik masyarakat Yang dibentuk oleh lembaga pembentuk hukum yang relatif otonom, maka penulisan tesis ini bermaksud memberi jawaban tersebut dengan mengambil setting kajinan masyarakat nelayan Muncar Banyuwangi.Tesis ini di¬dulamg dari hash penelitian dengan dua jenis data (data primer dan sekunder). Data primer yang terkait dengan proses pembentukan hukum diperoleh langsung dari para nelayan melalui pengamatan dan wawancara, sedangkan data sekunder berupa dokumen peraturan perandang-undangan dan berita massa media dikumpulkan dengan menggunakan metode dokumenter. Analisis terhadap kedua data tersebut menggunakan analisis kualitatif dan analisis isi. Adapun basil analisis keduanya disajikan secara deskriprtif kualitatif. Temuan yang diperoleh menunjukkan bahwa proses pembentukan Mikan dibidang kelautan dan perikanan lebih bersifat top down, hal ini menimbulkan dampak yaittel).Aturan-aturan hukum yang berkaitan dengan penangkapan ikan oleh para nelayan lebih mengakomodasi kepentingan ekonomi politik kelompok pengusaha ikan. 2).Terbatasnya mayoritas masyarakat nelayan untuk berpartisipasi dalam proses pembentukan hukum membuat mereka tidak memiliki akses baik dibidang ekonomi politik yang menyangkut kepentingan nelayan.Tiadanya akses para nelayan tersebut bukan berarti is sama sekali berada dalam posisi yang tidal( berdaya mengahadapi pemerintah. Terhadap berbagai kebijaksanaan pemerintah yang mereka anggap tidak adil atau merugikan kepentingan ekonomi politiknya para nelayan biasanya punya cara-cara tersendiri untuk memperjuangkan kepentingannya agar diterima menjadi bagian ketentuan dari peratutan perundang-tmdangan. Cara-cara loins yang sering ditempuh para nelayan dalam mempengaruhi proses pembentukan hukum, biasanya diungkapkan dalam bentuk protes, unjuk rasa, demonstrasi atau cara-cara lain yang bersifat destruktif, disamping bentuk-bentuk lainnya seperti memanfaatkan profesi wartawan dengan media masa cetak sebagai saluran untuk mempengaruhi proses pembentukan hukum. Dan ternyata hasilnya cukup efektif. Meskipun dalam kasus-kasus tertentu kelompok mayoritas nelayan ini telah mampu memaksa pemerintah, namun peraturan tersebut temyata belum menimbulkan perubahan kehidupan social ekonomi mereka,untuk itu masih diperlukan alternatif lain dalam rangka pemberdaya-an masyarakat nelayan. Strategi alternatif yang digunakan dalam tesis ini adalah merubah sistem kepemilikan alat tangkap dari sistem kepemilikan individual sistem kepemilikan secara kolekti
