TANGGUNG JAWAB DOKTER DALAM PERJANJIAN TERAPEUTIK DI RUMAH SAKIT UMUM TUGUREJO SEMARANG (THE RESPONSIBILITY OF THE DOCTOR FOR THE THERAPEUTIC AGREEMENT IN THE PUBLIC HOSPITAL TUGUREJO )

The occurrence of professional relationship between the doctors and the patients are related to the effort of patient recovery, which is named as therapeutic agreement. In fact, the meaning matter of these therapeutic agreement are still confusing because many circle make a different perception, both the circle of the doctor, patient/ society and the other relevant parties. So that the responsibility of the doctors that are usually neglected by the patients. Therefore need to know the fact what the happen to the therapeutic agreement is and how the responsibility of the doctor towards the patient over the medic action which has already been taken is. To know those things then the research had already been made by using the empirical juridical approaching which is then analyzed qualitatively by using the interpretation method. The research results showed that the therapeutic agreement between the doctor and the patient is less attended by all of the related parties especially the patient. Because the unknowing and the fear of the patient for asking, thus because of the general unknowing of the patient what the happen is while the medical treatment is done and wrong asking for a responsibility to the doctor. So that the doctor can be asked for his responsibility of the medical treatment that is taken if the patient is losing it out. But the determination of guilty or not needs evidences. Peristiwa terjadinya hubungan profesional antara dolcter dengan pasien, yang berkaitan dengan usaha untuk memperoleh kesembuhan bagi pasien, kita disebut sebagai perjanjian terapeutik. Namun ternyata soal perjanjian terapeutik ini masih rancu pengertiannya karena pelbagai kalangan membuat persepsi yang berbeda, balk kalangan dokter, pasien/masyarakat maupun pihak yang terkait lainnya. Begitu juga dengan tangg-ung jawab dokter yang seringkaii diabaikan pasien. Oleh karena itu perlu diketahui bagaimana sebenamya yang terjadi pada perjanjian terapeutik dan bagaimana tanggung jawab dolcter pada pasien atas tindakan medik yang telah diambil. Untuk mengetahui hal tersebut maka dilakukan penelitian dengan menggunakan pendekatan yuridis empiris yang kemudian dianalisa secara kualitatif dengan metode interpretasi atau penafsiran. Basil penelitian menunjulckan bahwa perjanjian terapeutik antara dokter dan pasien kurang diperhatikan oleh para pihak terutama pasien. Karena ketidaktahuan dan rasa talcut untuk bertanya, sehingga menyebabkan pasien yang karena keawamannya tidak mengetahui apa yang terjadi waktu tindakan medik dilakukan dan salah meminta pertanggungjawaban dari dokter Dengan demikian dokter memang dapat dimintakan pertanggungjawabannya atas tindakan medik yang diambil jika temyata pasien mengalami kerugian. Namun penentuan bersalah tidaknya dolcter perlu adanya pembuktian
