The aim of this paper is to discuss a concept that has risen a lot of questions in the Land Law of Kenya. This is the concept of the equitable customary trust. The concept is a judicial intervention to mitigate certain harsh aspects of the introduction of individual title and land registration in the African areas of the country where land was governed by customary law rules.
