The idea of inclusive education has gained prominence in the ideological context of modern Western democracies. Thus, this analysis focuses on the understanding of how the Brazilian inclusive education has been managed from the Decree-Law n ° 6.571/2008, which was repealed on November 17, 2011, considering the formalism perspective. Formalism is taken as a perspective of analysis of the inclusive public policies, which allows us to question the apparent stability and uniformity of institutional practices and discourse of the national administration.
