Cases of conflict over rights on water are on the rise. These rights of the users to use water can be classified into two broad groups- human rights and property rights. The paper discusses the way these rights evolved and the way the courts have interpreted those rights. While focusing on the mecha-nism for allocation of property right over groundwater, the paper makes an attempt to address the problem where different types of rights of individuals clash against each other. It then discusses the status and scope of the fun-damental right to water in the light of the Plachimada (a village in Kerala, India) experience, where extraction of groundwater by Coca-Cola company allegedly caused drinking water scarcity for the locals
