local twenty year veteran schoolteacher, Ray Webster, was told in a letter written by Superintendent Alex M. Martino, dated October 1987, that he was to teach only one side of the creation/evolution controversy, the atheistic evolution side. Ray was acknowledged as an excellent teacher by both sides of this litigation. The letter from Martino openly suppressed Ray’s contention that he had an obligation to teach both sides of controversial issues. Realizing the injustice of this directive, which was contrary to the Supreme Court ruling that teachers are not to be forced to teach any one viewpoint on origins, Ray Webster looked to the courts for support.
